1. מבוא והסכמה לתנאים

ברוכים הבאים לפלטפורמת Tovora (להלן: "הפלטפורמה" או "השירות"). Tovora הינה מערכת מתקדמת למעקב תזונה ואימונים המבוססת על טכנולוגיית בינה מלאכותית (AI), המופעלת ומנוהלת על ידי עידן עמר (Idane Amar) מרעננה, ישראל (להלן: "המפעיל").

הגישה לפלטפורמה, ההרשמה אליה והשימוש בה מותנים בהסכמתך המלאה לתנאים המפורטים במסמך זה. עצם השימוש בשירות מהווה אישור מוחלט ובלתי חוזר לכך שקראת, הבנת והסכמת לתנאים אלו. במידה ואינך מסכים לתנאי כלשהו, הנך מתבקש לחדול לאלתר מכל שימוש במערכת.

הגבלת גיל: השירות מיועד למשתמשים בגיר בני 18 ומעלה. קטינים בני 16 עד 18 רשאים לעשות שימוש בשירות אך ורק בכפוף לאישור ופיקוח פעיל של הורה או אפוטרופוס חוקי. השימוש בשירות עבור קטינים מתחת לגיל 16 הינו אסור בהחלט.

2. היעדר התוויה רפואית והסתייגות בינה מלאכותית (AI & Health Disclaimer)

סעיף זה הינו מהותי וקריטי לאופן השימוש בפלטפורמה. אנא קרא אותו בעיון:

הפלטפורמה משלבת כלי בינה מלאכותית של צדדים שלישיים (ובפרט מודלים ממשפחת Google Gemini) לצורך ניתוח ויזואלי של ארוחות, חישוב ערכים תזונתיים והפקת תובנות טקסטואליות. מובהר בזאת כי:

כלל המידע, התשובות, התפריטים, הערכות הקלוריות והתובנות המופקות על ידי המאמן הווירטואלי אינם מהווים ייעוץ רפואי, תזונתי או פסיכולוגי מוסמך.
השירות אינו מחליף בשום אופן התייעצות מקצועית ואישית עם רופא מומחה, דיאטן קליני מוסמך או מאמן כושר מקצועי.
חישובי המאקרו-נוטריאנטים, ההוצאה האנרגטית ויעדי המשקל הינם הערכות סטטיסטיות בלבד ועשויים לכלול סטיות או אי-דיוקים.

במידה והנך מתמודד עם מצב רפואי קיים (לרבות אך לא רק: סוכרת, מחלות רקע, היריון, הפרעות אכילה או אלרגיות), עליך להיוועץ בגורם רפואי מוסמך טרם ביצוע כל שינוי תזונתי. המפעיל מסיר מעצמו כל אחריות מפורשת או משתמעת לכל טעות, אי-דיוק, או נזק (גופני, נפשי או כלכלי) שייגרם כתוצאה מהסתמכות על תוצרי הפלטפורמה. השימוש במידע המופק מהמערכת נעשה על אחריותך הבלעדית.

3. ניהול חשבון, אבטחה ושימוש הולם

בעת יצירת חשבון, הנך מתחייב למסור פרטים מדויקים ועדכניים. הנך נושא באחריות הבלעדית לשמירה על סודיות פרטי הגישה שלך (שם משתמש וסיסמה) ולכל פעילות אשר תתבצע תחת חשבונך. החשבון הינו אישי ואינו ניתן להעברה או לשיתוף.

חל איסור מוחלט לבצע כל פעולה העלולה לפגוע בתקינות הפלטפורמה, לרבות: הנדסה לאחור (Reverse Engineering) של קוד המערכת או המודלים; ביצוע סריקות אוטומטיות (Scraping); העמסה זדונית על השרתים; או שימוש בשירות למטרות בלתי חוקיות.

4. תוכן משתמש ובעלות על מידע

כל מידע שתבחר להזין למערכת – לרבות נתוני ארוחות, יומני אימונים, תמונות והקלטות שמע – נשאר בבעלותך המלאה והבלעדית. בהזנת המידע, הנך מעניק למפעיל רישיון מוגבל ולא בלעדי לעבד נתונים אלו אך ורק לשם אספקת השירות ותפעולו עבורך.

אנו מכבדים את הריבונות שלך על הנתונים: בכל עת, הנך רשאי לייצא את נתוניך או למחוק את חשבונך לצמיתות (כולל כל המידע המקושר אליו) באופן עצמאי דרך תפריט ההגדרות.

5. מודל שירות ומסלולים

נכון למועד פרסום תנאים אלו, שירותי הבסיס בפלטפורמה מסופקים ללא עלות. המפעיל שומר לעצמו את הזכות לפתח ולהציע בעתיד מסלולי פרימיום בתשלום (כגון "Tovora Plus"). כל השקה של מסלול בתשלום תלווה בהודעה מוקדמת וברורה. היכולות המוגדרות כיום כחינמיות ימשיכו להיות זמינות ללא תשלום גם לאחר השקת מסלולי הפרימיום.

6. קניין רוחני (Intellectual Property)

כל זכויות הקניין הרוחני בפלטפורמה – לרבות אך לא רק: קוד המקור, עיצוב הממשק (UI/UX), הלוגו, המותג "Tovora", האלגוריתמיקה והטקסטים – הינן רכושו הבלעדי של המפעיל ומוגנות תחת חוקי זכויות היוצרים בישראל ובעולם. אין להעתיק, לשכפל, להפיץ, להציג בפומבי או ליצור יצירות נגזרות מכל חלק שהוא בפלטפורמה ללא אישור מפורש בכתב מאת המפעיל.

7. הגבלת אחריות (Limitation of Liability)

השירות מסופק למשתמשים במתכונתו הנוכחית ("AS-IS") ועל בסיס זמינות ("AS-AVAILABLE"), ללא כל הצהרה או התחייבות מפורשת או משתמעת באשר לזמינותו הרציפה, חסינותו מפני תקלות סייבר או דיוק נתוניו.

במידה המקסימלית המותרת על פי דין, גובה האחריות המצטברת של המפעיל כלפיך, בגין כל טענה או תביעה הנובעת משימוש בשירות, לא יעלה על סך התשלומים ששולמו על ידך למפעיל ב-12 החודשים שקדמו לאירוע (או לחילופין סך של 100 ש"ח, במידה והשימוש נעשה במסלול החינמי).

8. סיום התקשרות והשעיית חשבון

המפעיל שומר לעצמו את הזכות הבלעדית להשעות או להפסיק לאלתר את גישתך לשירות, ללא הודעה מוקדמת, במקרה של הפרת תנאים אלו, או אם יתעורר חשד סביר לפעילות העלולה לפגוע במשתמשים אחרים או במערכת.

כמו כן, המפעיל רשאי להפסיק את הפעלת הפלטפורמה כולה בהתרעה של 30 ימים מראש, תוך מתן חלון זמן סביר למשתמשים לייצא את נתוניהם. משתמש רשאי לסיים התקשרות זו בכל עת על ידי שימוש באפשרות "מחיקת חשבון לצמיתות" בממשק האפליקציה.

9. סמכות שיפוט ודין חל

על תנאי שימוש אלו ועל כל פועל יוצא מהם יחולו אך ורק דיני מדינת ישראל. סמכות השיפוט הבלעדית והייחודית לדון בכל מחלוקת או סכסוך הנובעים מהשימוש בפלטפורמה תהא מסורה לבתי המשפט המוסמכים במחוז תל אביב-יפו.

1. Introduction and Acceptance of Terms

These Terms of Service (the "Terms") constitute a legally binding agreement between you (the "User") and Idane Amar, based in Ra'anana, Israel (the "Operator"), governing your access to and use of the Tovora platform (the "Platform" or "Service"), an AI-powered nutrition and fitness tracking application.

By accessing, registering for, or utilizing the Service—whether via a web browser, Progressive Web App (PWA), or any other interface—you acknowledge that you have read, understood, and unequivocally agree to be bound by these Terms. If you do not agree to these Terms in their entirety, you are strictly prohibited from using the Service.

Age Restriction: The Service is strictly intended for individuals who are at least eighteen (18) years of age. Minors aged sixteen (16) or seventeen (17) may utilize the Service only under the direct, active supervision and explicit consent of a parent or legal guardian. Access or use of the Service by anyone under the age of sixteen (16) is strictly prohibited.

2. CRITICAL NOTICE: Medical and Artificial Intelligence Disclaimer

This section contains vital limitations regarding the nature of the Service. Please review it carefully.

The Platform employs advanced third-party Artificial Intelligence (AI) technologies, specifically Google Gemini models, to analyze visual inputs, estimate nutritional values, and generate text-based insights. You hereby acknowledge and agree to the following:

No Medical Advice: The information, dietary plans, macro-nutrient estimates, recommendations, and insights generated by the virtual coach or any system component do not constitute medical, clinical, nutritional, or psychological advice. The Service is not a substitute for professional medical consultation, diagnosis, or treatment by a licensed physician, clinical dietitian, or certified fitness professional.
Inherent Inaccuracies: All quantitative outputs—including but not limited to caloric estimates, energy expenditure, and weight-loss trajectories—are statistical estimations. They are inherently subject to inaccuracies, anomalies, or "hallucinations" common to generative AI models.
Pre-existing Conditions: If you suffer from any medical condition (including, without limitation, diabetes, eating disorders, cardiovascular disease, kidney disease, allergies, or if you are pregnant), you must consult a licensed healthcare provider prior to implementing any dietary or physical regimen suggested by the Platform.

Assumption of Risk: The Operator disclaims any and all liability for errors, computational inaccuracies, or any direct, indirect, physical, psychological, or financial harm resulting from your reliance on the Platform's outputs. Your use of the Service is entirely at your own risk.

3. Account Registration, Security, and Acceptable Use

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration. You are solely responsible for safeguarding your account credentials and for all activities occurring under your account. Account sharing is strictly prohibited; each account is licensed to a single individual.

Prohibited Conduct: You agree not to engage in any of the following activities: (a) reverse-engineering, decompiling, or attempting to extract the source code or AI models underlying the Platform; (b) employing automated scripts, bots, or scraping tools to extract data; (c) intentionally overloading, disrupting, or attempting to breach the Platform's servers; or (d) utilizing the Service for any unlawful or unauthorized purpose.

4. User Content, Data Sovereignty, and Licensing

You retain full and exclusive ownership of all data you input into the Service, including dietary logs, workout records, uploaded images, audio recordings, and conversational text. By submitting this data, you grant the Operator a limited, non-exclusive, royalty-free license to process this information solely for the purpose of operating, maintaining, and delivering the Service to you.

In accordance with our Privacy Policy, you retain absolute sovereignty over your data and may, at any time, export your records or permanently delete your account and all associated data via the settings menu.

5. Service Tiers and Future Monetization

As of the Effective Date of these Terms, the core Service is provided free of charge. The Operator reserves the right to develop and introduce premium, paid subscription tiers (e.g., "Tovora Plus") in the future. The introduction of any paid tier will be communicated with a minimum of thirty (30) days' advance notice. Features currently designated within the free tier will remain accessible at no cost following the launch of premium plans.

6. Intellectual Property Rights

All proprietary rights, title, and interest in and to the Platform—including its source code, UI/UX design, the "Tovora" brand, logos, algorithms, and associated intellectual property—are the exclusive property of the Operator (Idane Amar) and are protected by Israeli and international copyright and trademark laws. You are granted no rights to copy, reproduce, distribute, or create derivative works from any part of the Platform without express written consent.

7. Limitation of Liability

To the maximum extent permitted by applicable law, the Service is provided on an "AS-IS" and "AS-AVAILABLE" basis, without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Under no circumstances shall the Operator be liable for any indirect, incidental, consequential, special, or exemplary damages. The Operator's total aggregate liability arising out of or related to these Terms or your use of the Service shall not exceed the total amount paid by you to the Operator during the twelve (12) months immediately preceding the claim, or thirty US Dollars ($30.00 USD), whichever is greater.

8. Term, Termination, and Suspension

The Operator reserves the right to suspend or terminate your access to the Service immediately and without prior notice if you breach these Terms, engage in conduct detrimental to the Platform or other users, or pursuant to a lawful directive from a competent authority.

The Operator may also discontinue the Service in its entirety at its sole discretion, provided that active users receive thirty (30) days' prior notice to facilitate data exportation. You may terminate this agreement at any time by executing the permanent account deletion protocol within the app.

9. Governing Law and Exclusive Jurisdiction

These Terms, and any disputes arising out of or relating to them, shall be governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of law principles. You consent to the exclusive jurisdiction and venue of the competent courts located in the Tel Aviv District, Israel, for the resolution of any legal proceedings.
